A TRANSIT driver with only a provisional licence was guilty of drink driving on the A59 at Bolton Abbey, heard magistrates.

Police officers on patrol near Menwith Hill on July 30 received reports of a vehicle being driven erratically, the court heard today (Friday).

They identified the white Ford Transit Connect and after seeing it swerve from the centre line to the verge, stopped the vehicle.

Driver, Frank Coglan provided a positive roadside breath test and was taken to the police station where he was found to have 69 microgrammes of alcohol in 100 millilitres of breath, the legal limit is 35.

The court was told Coglan was fully cooperative with officers, telling them he was driving on a provisional licence.

Coglan, 28, of Jedburgh Drive, Darlington, admitted drink driving, driving without a full licence and without insurance.

In mitigation, Gulfraz Khan, said Coglan had been shocked to learn he had been over the limit. Coglan could drive, he just did not have the valid documentation added Mr Khan.

He said Coglan was a self employed block paving contractor and the loss of his licence would have a detrimental effect on his work. He hoped to be able to rely on friends and colleagues.

Coglan was banned from driving for 22 months, fined £120, and ordered to pay a surcharge of £34 and costs of £85. If he completes a drink driver rehabilitation course, his ban will be reduced by 22 weeks. His licence will also be endorsed.
