Notice of Confirmation of a Public Path Diversion and Definitive Map and Statement Modification Order Highways Act 1980 Wildlife and Countryside Act 1981 North Yorkshire County Council Public Bridleways No. 20.58/3 & 20.58/11 and Footpath No.20.58/12 Scorton Quarry Diversion Order 2017
On 10 October 2017, North Yorkshire County Council confirmed the above Order made under Section 119 of the Highways Act 1980 and Section 53A(2) of the Wildlife and Countryside Act 1981. The effect of the confirmed Order is to divert the public bridleways described below and modify the District of Richmondshire (Outside the Yorkshire Dales National Park) Definitive Map and Statement accordingly.
Bridleway No.20.58/3: The section from GR 42395 50077 running generally south east to GR 42461 50030 will be diverted onto a new line starting at GR 42477 50067 and running generally south then south west to GR 42445 50035, then south south west along a track running parallel to the old road to GR 42439 50005, then generally east north east to GR 42465 50012, then generally south south east to GR 42474 49986. A new section of bridleway will be created to link the end of Bridleway No.20.58/3 at GR 42395 50077 to Bridleway No.20.58/13 at GR 42418 50088. A new section of bridleway will also be created between GR 42465 50012 and GR 42483 50021 to link Bridleway 20.58/3 with Banks Lane.
Bridleway No.20.58/11: The section from GR 42446 49981 running generally east to GR 42460 49982 and the section from GR 42469 49983 running east north east to GR 42474 49986 will be diverted to follow the existing track between those points. A new section of bridleway will be
created between GR 42472 49983 and GR 42472 49982 to link Bridleway 20.58/11 with Back Lane.
Footpath No.20.58/12: the section between GR 42469 49983 and GR 42473 49989 will be deleted.
A copy of the confirmed Order and Order map may be seen free of charge during normal office hours at Richmond Library, North Yorkshire DL10 4AE until 08 December 2017. Copies of the Order and map may be purchased from Waste & Countryside Services, North Yorkshire County Council, County Hall, Northallerton, North Yorkshire, DL7 8AD (tel: 01609 532512) at a cost of £2.00, or can be downloaded free from our website www.northyorks.gov.uk/pathnotices. The Order comes into force on 10 October 2017, but if a person aggrieved by the Order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980 as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may, under Paragraph 2 of Schedule 2 to the Act as applied by Paragraph 5 of Schedule 6 to the Act, within six weeks from 27 October 2017, make an application to the High Court.
