Dennis Gillson and Son Ltd. has applied to the Secretary of State for Environment, Food and Rural Affairs for consent under Section 38 of the Commons Act 2006 to carry out restricted works on Brow Moor Common. The Planning Inspectorate will decide the application on behalf of the Secretary of State. The proposed works are: A small extension to the quarry, as approved under Planning Permission ref: 18/03635/MAF, with an area of approximately 1.25ha (3.1 acres) of Brow Moor. The extension area occupies just 2.75% of the Common Land. The extension area would be fenced off for health and safety reasons, and to prevent unauthorised access to the working quarry. The works will cease not later than 2042, and the quarry will be restored with the aim of enhancing biodiversity and habitats for flora and fauna, and reducing landscape impact. Postrestoration, public access and commoners’ rights will be restored. Fencing will remain at the top of retained quarry faces. The works will be located to the east of the existing quarry as shown in both the Planning Permission and the Section 38 Application documents. The works will not affect the route of any public footpath. Additionally, the Planning Permission contains an obligation to provide material for the repair of footpaths on Brow Moor.
